Terms and Conditions
1. All “Terms and Conditions” of the Jomare Online Store apply to all equipment ordered on this website.
2. The Customer should carefully read the “Terms and Conditions” each time they access the website.
Safety conditions
3. The data collected is mandatory and confidential, and is intended solely for invoicing the purchased product(s) and shipping the order.
4. Despite using security procedures inherent to this business area, there are risks associated with using the Internet over which Jomare has no control.
5. Jomare expressly disclaims any responsibility for loss or delays in data transmission via the Internet between the Customer and the Jomare Online store.
6. Jomare’s liability for losses and/or damages is limited to the value of the products ordered.
Products and Prices
7. Jomare offers a wide range of products for sale through its online store.
8. The offer for each product is subject to availability.
9. Jomare reserves the right to replace or modify the available products, their prices, and the conditions presented at any time and without prior notice.
10. If the Customer continues to access the website, it will be considered that they have accepted these changes.
11. All prices include VAT at the current legal rate.
12. Prices are always shown in Euros.
Order requests
13. Orders can be placed on the Jomare Online Store 24 hours a day, 7 days a week.
14. While browsing the Online Store, you can add items to your shopping cart by clicking the “Add to cart” button.
15. Once you have finished selecting your products, you can select the “x Products” option at the top of the website to make your purchase.
16. In the “delivery location” field you can choose to pick up your order at our Valados store, located at Rua Eng. Costa Matos N.1-5, 9500-681 Ponta Delgada, or have it delivered to your home.
16.1 We deliver to the mainland, the Azores Islands and the Madeira Islands.
16.2 There are no shipping costs when picking up your order at the Valados store.
17. After entering your personal details, please also confirm your intention to place the order.
18. Once confirmed, the order will be sent to Jomare and cannot be cancelled, except for the right of withdrawal under points 33 to 36.
19. Your order will not be accepted and the contract will not be concluded until you receive, by email, confirmation of acceptance of the order and make the payment.
20. Orders will only be accepted for delivery within mainland Portugal and the autonomous regions of Madeira and the Azores.
Package delivery
21. The order will be delivered by courier (CTT, EMS or other service), by our transport company to the address indicated, between 9 am and 7 pm on weekdays, or by a freight forwarder to their warehouse (contact details and address will be sent by email).
22. The shipping time will, in principle, be up to 48 hours on working days, from the date of receipt and confirmation of payment of the order by Jomare, except in cases of stock shortages, in which an alternative shipping time will be proposed.
23. Delivery will be made upon signature of the receipt by any person present at the indicated address, who will then be responsible for delivering the item to the Customer.
24. If no one is at the indicated address, the order will remain at the local post office for 3 business days, after which it will be returned to Jomare. If the order is shipped via a freight forwarder, the customer has 1 month to collect it. For all other orders, the items will be returned to Jomare, and a new delivery will be scheduled, with the cost borne by the customer.
25. Payment must be made at the time of order confirmation via MB Reference, Paypal or at our Valados store.
26. If the order is not delivered because there is no one to receive it (in situations where the service is scheduled), the buyer will have to compensate Jomare with 20% of the order value.
Payments
Pay in 3 or 4 interest-free installments with a credit or debit card through your Floa partner.
Payment in installments is offered by Floa, a public limited company (société anonyme), registered in the Bordeaux Commercial Register under number 434 130 423 and registered with the French Prudential Supervision and Resolution Authority (ACPR) under number 14628, with its registered office at Bâtiment G7 – 71 Rue Lucien Faure in Bordeaux (33300), France. Floa operates in Portugal under the European passport regime. It offers payment solutions reserved for individuals (natural persons of legal age) residing in Portugal and holding a Visa or MasterCard bank card with an expiry date corresponding to the repayment period, allowing them to pay for their purchases of goods and/or services through “Payment in 3 installments” or “Payment in 4 installments”, without interest. Example payment: €300 in 3 installments of €100 or €300 in 4 installments of €75. Total: €300. No interest or fees apply. APR (Annual Percentage Rate):
0.0%.
After completing your order, you must choose to pay using your preferred payment method, “Payment in 3 installments” or “Payment in 4 installments” by Credit or Debit Card; you will then be redirected to the Floa website where you can make your payment. Floa reserves the right to accept or refuse the financing request; the customer may cancel the payment request within 14 days. For more information, click here .
Please note that if you request payment for your order of goods and/or services using these payment methods, your personal data will be transmitted to Floa for the purposes of analyzing the financing request, managing the credit agreement and, if applicable, debt recovery. Guarantee
28. Products purchased from the Online Store have a two-year warranty, unless expressly stated otherwise.
29. To benefit from this guarantee, the Customer must keep the invoice as proof of purchase.
Contract termination
30. The Customer has the right to cancel the purchase if they do not receive their product within a maximum period of 30 days.
31. The Customer has, under the law, the right to terminate the contract, which must be exercised by means of a registered letter with acknowledgment of receipt, sent within a maximum period of 14 days from the date of receipt of the order.

In other words:
The cooling-off period for customers making distance purchases, during which they can return the purchased goods, is now 14 days throughout the European Union. (Law).

32. In the event of contract termination, the Customer has a maximum period of 30 days from the date of receipt of the order to return the purchased product(s) to Jomare at the address indicated above, with the respective packaging(s) in excellent condition, together with the sales invoice and proof of receipt of the order.
33. After receiving the returned order and all the documents referred to in the previous point, Jomare will reimburse the amounts paid by the customer within a maximum period of 30 days, without any expenses for the customer, except as provided in the following point.
34. Jomare reserves the right not to accept the termination of the contract if the product is not returned in the same condition in which it was sent, specifically without signs of having been used or damaged, in which case Jomare will return the product to the customer without any refund of the price.
Final provisions
35. All electronic messages sent during access to the online store, including emails and messages through an internet browser, will be considered, for the purposes of applicable law, as contractual statements.
36. Jomare may send the Customer information about new products, promotions, or other information of interest to Online Store Customers.
